10 YEAR GUARANTEE
for PVC-U Windows and Doors & GRP Composite Doors
as supplied and installed in residential installations by GJB New Build (“The Company”) as principal contractors.
1) TEN YEAR GUARANTEE AND UNDERTAKING
For a period of ten years from the date of completion of installation for the PVC-U frame. This is for distortment to the frame only. Five years for sealed double/triple glazed units and one year for ironmongery and ancillary fittings.
The Company undertakes to make good, free of charge, any fault in the installation within the first two years (as contractually defined), which develops due to defective materials, construction or workmanship.
The Company will make good the fault, as soon as is reasonably practicable, by modification repair or replacement as, at its sole discretion, it shall deem necessary. In the event of replacement, it reserves the right to use such materials as it shall think fit subject to their being of quality and type in no way inferior to and, so far as possible, in all other respects, commensurate with those supplied under the terms, of the original contract.
2) CONDITIONS OF UNDERTAKING
The Company shall only be bound by the terms of the undertaking given providedthat:
a) The alleged defect has been brought to the Company within 30 days of it being apparent to the Customer. Notwithstanding such notification shall also be void in respect of any damage caused to the guaranteed goods which would not have occurred but for the customer’s unreasonable delay in notifying the Company of the defect.
b) The installation has in no way whatsoever been modified, worked upon or otherwise tampered with save by a person or persons duly authorised by the Company.
c) The Company has been afforded such access to the property as shall be necessary to enable inspection, evaluation and remedial work to be effected.
d) The Company does not guarantee that the installation of the guaranteed goods will either reduce or eliminate condensation nor that any sealed glazed units will be free from condensation (other than within the sealed units itself). Furthermore the Company accepts no liability for any condensation appearing within the property after installation of the guaranteed goods where none was apparent before.
3) EXPRESS EXCLUSIONS
The Company expressly excludes any liability whatsoever arising in any of the following circumstances:
a) Misuse, neglect, carelessness, lack of maintenance, fair wear and tear, vandalism, civil commotion or disturbance, enemy action or Act of God whether affecting the installation as the result of any such event affecting the fabric of the property in which the installation is situated. Any attempt made at repair, replacement or modification by the Customer, or any third party without the prior written consent of the Company
b) Any materials other than those incorporated in the manufactured sealed unit, glass and glazing materials, PVC-U, fixtures, fittings and installation materials save the natural effects of passage of time and weather ‑ notably excluded is wood.
c) Optical effects attributable to natural phenomena.
d) Where a period of excess of ten years (frames only), ( 1 year ironmongery and ancillary fittings), (2 years for adjustments), ( 5 years sealed units) has expired from the date of completion of the original installation ‑to the intent that this Guarantee and undertaking whilst applying to any modified or replacement material supplied and fitted by the Company on its authorised agent shall only apply for ten years from the original completion of installation. This Guarantee and undertaking is given conditional upon the account for the installation having been paid in full under the terms of the contract or otherwise secured to the satisfaction of the Company as acknowledged in writing.
e) This undertaking is made solely to the Name/Client shown on this guarantee and cannot be assigned to a third party without the written permission of the Company
